Abstract: The University has played an important role since the ancient period in developing intellectually, morally, culturally and socially responsible people. Throughout its long history, many philosophers have contributed to the philosophy of university and a good number of models or theories have been developed. In its long journey, sometimes universities have adapted to changing social, economic and cultural environments and the other times they have played a pivotal role in changing society. The paper shows the reciprocal relationship between society and the university. It discusses the nature of the university and analyzes the theories of some prominent philosophers, such as Wilhelm von Humboldt, John Henry Newman, Karl Jaspers, Clark Kerr and Paulo Freire regarding philosophy of higher education or philosophy of the university. By examining these theories, this paper explains the multidimensionality of the philosophy of university that reveals the nature, scope and goals of the university. This paper demonstrates the crisis of contemporary higher education and, in this regard, pays special attention to the neoliberal philosophy that influences its commercialization. According to neoliberal philosophy, knowledge is a commodity produced by the university, and students are the customers of this commodity. Moreover, this paper briefly discusses the nature of the corporate university and the ecological university. Finally, this paper recommends a balanced curriculum, an active learning process, proper utilization of technology, and the strengthening of academic freedom and moral leadership for the development of higher education.

Abstract: Notwithstanding Bangladesh’s status as a Muslim-majority state, a significant portion of its extant laws is inherited from the colonial era, predicated primarily upon secular Western legal philosophy. Consequently, various structural and institutional limitations and impediments are observed in the comprehensive and efficacious implementation of the principles of Sharia-based justice, social equity, and moral rectitude. This article succinctly analyzes the concept of law, an introduction to Islamic law, the theoretical foundations of the Islamization of laws, and the historical evolution of theBangladeshi legal system.Furthermore, within the democratic framework, the existing challenges to the Islamization of the prevailing legal system in Bangladesh are identified, and potential, pragmatic remedial strategies are presented through comparative and analytical methodologies. This research endeavors to construct an integrated, balanced, and applicable perspective in light of the Qur'an, Sunnah, various jurisprudential (Fiqh) schools, and modern legal thought, which may contribute significantly to legal reform, the establishment of a justice-based society, and sustainable policy development within the context of Bangladesh. সারসংক্ষেপ : বাংলাদেশ একটি মুসলিম সংখ্যাগরিষ্ঠ রাষ্ট্র হলেও এর বিদ্যমান আইনসমূহের একটি বৃহৎ অংশ ঔপনিবেশিক আমল থেকে উত্তরাধিকারসূত্রে প্রাপ্ত, যা প্রধানত ধর্মনিরপেক্ষ পাশ্চাত্য আইনদর্শনের ভিত্তিতে প্রণীত। এর ফলে ইসলামী শরীয়াভিত্তিক ন্যায়বিচার, সামাজিক সুবিচার ও নৈতিক শুদ্ধতার নীতিসমূহের পূর্ণাঙ্গ ও কার্যকর বাস্তবায়নের ক্ষেত্রে বিভিন্ন কাঠামোগত ও প্রাতিষ্ঠানিক সীমাবদ্ধতা ও প্রতিবন্ধকতা পরিলক্ষিত হয়। আলোচ্য প্রবন্ধে আইনের ধারণা, ইসলামী আইনের পরিচয়, আইনের ইসলামিকরণের তাত্ত্বিক ভিত্তি এবং বাংলাদেশের আইনব্যবস্থার ঐতিহাসিক বিকাশ সংক্ষেপে বিশ্লেষণ করা হয়েছে। পাশাপাশি গণতান্ত্রিক কাঠামোর পরিসরে বাংলাদেশের প্রচলিত আইনব্যবস্থায় আইনের ইসলামিকরণে বিদ্যমান সমস্যাবলি চিহ্নিত করে সম্ভাব্য ও বাস্তবসম্মত উত্তরণ কৌশলসমূহ তুলনামূলক ও বিশ্লেষণাত্মক পদ্ধতিতে উপস্থাপন করা হয়েছে। গবেষণায় কুরআন ও সুন্নাহ, বিভিন্ন ফিকহী মতবাদ এবং আধুনিক আইনচিন্তার আলোকে একটি সমন্বিত, ভারসাম্যপূর্ণ ও প্রয়োগযোগ্য দৃষ্টিভঙ্গি নির্মাণের প্রয়াস গ্রহণ করা হয়েছে, যা বাংলাদেশের প্রেক্ষাপটে আইন সংস্কার ও ন্যায়ভিত্তিক সমাজ প্রতিষ্ঠা এবং টেকসই নীতিগত উন্নয়নের ক্ষেত্রে তাৎপর্যপূর্ণ অবদান রাখতে পারে।

Abstract: Thoughts of Islamic banking has essentially begun as a preventive measure against usurious banking system. That is why, some ideological aspects of Islamic economics had to be given way in the beginning as ‘interim’ considerations. One of those ‘interim’ issues is the interest-bearing banking savings system. In keeping with this, the DPBM’ (Daily Product Basis Method) method was approved on a temporary basis. This method is valid though; However, it does not reflect the ideal application of Mudarabah due to various reasons. Islamic banking is now almost half a century old. Many contemporary jurists feel that there is a need to think and research a more sustainable model for Islamic banking in addition to those ‘interim’ considerations. This article has proposed some ideal and unique outlines and models for Islamic banking through a review of conventional savings systems. The ‘Trading House Model’ has been proposed as the prime ideological model and it will be managed on the basis of Mudarabah and Shirkat. Besides, loan-based savings house model and waqf house model have also been proposed through deductive method. The author argues that although there are complications in the implementation of these models, it would not be fitting to practice the Islamic banking model based on the ongoing Murabaha, DPBM system. ইসলামী ব্যাংকিং চিন্তা শুরু হয়েছে মূলত সুদী ব্যাংকিং পদ্ধতির প্রতিরোধমূলক ব্যবস্থা হিসাবে। যে কারণে শুরুতে ‘অন্তর্বর্তীকালীন’ বিবেচনায় ইসলামী অর্থনীতির আদর্শিক কিছু বিষয়ে ছাড় দিতে হয়েছিল। সেই ‘অন্তর্বর্তীকালীন’ বিষয়গুলোর অন্যতম হলো, সুদী ব্যাংকিং সঞ্চয় পদ্ধতি। একে বহাল রাখতে গিয়ে ‘ডিপিবিএম’ (ডেইলী প্রডাক্ট বেসিস মেথড) পদ্ধতি সাময়িককালের বিবেচনায় অনুমোদন দেয়া হয়েছিল। এ পদ্ধতি যদিও বৈধ; তবে এতে মুদারাবার আদর্র্শিক প্রয়োগ নানা কারণে প্রতিফলিত হয় না। বতর্মানে প্রায় অর্ধশতাব্দীকাল অতিক্রম করছে ইসলামী ব্যাংকিং। যুগসচেতন বিদগ্ধ ফকীহগণের অনেকেই মনে করেন এখন সেই ‘অন্তর্বর্তীকালীন’ বিবেচনাগুলের পাশাপাশি ইসলামী ব্যাংকিং এর জন্য আরও টেকসই কোনও মডেল নিয়ে চিন্তা ও গবেষণা করা দরকার। বক্ষ্যমাণ প্রবন্ধে প্রচলিত সঞ্চয় পদ্ধতির পর্যালোচনার মাধ্যমে ইসলামী ব্যাংকিং এর জন্য আদর্শ ও স্বতন্ত্র কিছু রূপরেখা ও মডেল প্রস্তাব করা হয়েছে। মূল আদর্শিক মডেল হিসাবে ‘ট্রেডিং হাউজ মডেল’ প্রস্তাব করা হয়েছে। যা মুদারাবা ও শিরকতের ভিত্তিতে পরিচালিত হবে। পাশাপাশি অবরোহ পদ্ধতির মাধ্যমে করজ ভিত্তিক সেভিং হাউজ মডেল ও ওয়াকফ হাউজ মডেলও প্রস্তাব করা হয়েছে। এসব মডেল বাস্তবায়নে জটিলতা থাকলেও চলমান মুরাবাহা, ডিপিবিএম পদ্ধতি ভিত্তিক মডেল অনুশীলন অব্যাহত রাখা সমীচীন নয়।
